Unfortunately just because your product is free doesn't mean you have the right to use other people's copyrighted materials. I'd expect a C&D from Disney's legal department if they ever catch wind of this as you are breaking the law, none of this falls under fair use.

Socks, they can't take it down, because it's for fun and entertainment, not for profit. Disney only cares about money and profit these days.

Like I say, whether something is distributed for free or for profit you still need permission to use copyrighted material, the idea that Disney can't take down a product that uses their intellectual property without permission goes against the core notion of copyright (the originator of the the work retains exclusive rights to the work's use / distribution).
Disney only cares about money and profit these days.
Agreed, that's why Disney's legal department are unlikely to allow a brand and reputation (they've spent decades building up) to be freely used and abused, represented and distributed by anyone who wants to, once they do it for free, it simply makes no sense (nor is it actually legal).

The same logic would mean anyone who wants to make computers (regardless how poorly made they might be) and stick Apple's branding and logo on them are free to, as long as they don't charge for the products (let's imagine they are part of a not-for-profit education grant or scheme, laptops distributed to poor students) . . . of course this would undermine Apple's reputation for quality and would damage the brand . . . but the reality is that you are not allowed to use copyrighted materials, logos and branding with permission for very good reasons, regardless of whether you charge or not.

@Socks How can any of Disney's fans show people how awesome Disney is, when they can't use any of their stuff due to stupid silly copyright laws that don't matter to anyone.

You can purchase/rent their movies? That's legal.

Not trying to give you a hard time, but you may want to take a really good look and reconsider this game. I don't want you to end up in trouble for using their content without their consent.

Yep, it's a dangerous game you're playing. Especially with one of the biggest players out there. In the end it's your decision, but you should rethink your idea...and while you're at it, also your design :) I don't want to sound rude, but that's just my two cents.

I don't know, that's an issue for the individual, but if you are keen to express your heartfelt love for some corporate giant you're probably best finding a legal way to do it, of course there's nothing compelling you to stick to the law, to any law, you are free like all of us to take your chances, and what you are engaged in here is a civil (rather than criminal) matter, so go for it if you want, that's up to you, personally I'd do it through the medium of expressive dance. :P

The thing is, they do matter, they matter to Disney, they matter to me, they might even matter to you one day, intellectual property is important, these are the same laws that say when, in 10 years time (or whenever) you produce a fantastic game, someone cannot simply come along and dilute your sales and damage your brand by producing their own version of your game, using direct copies of all your artwork and music and logos and branding and so on.

Imagine that . . . . you produce a brilliant game, a great idea, with great characters and gameplay, sales start to build, people love the game, it goes international, before you know it you are getting 100,000 downloads a week, you start to build a reputation as a great game maker . . . . but Chillingo spot the buzz around your new game, they also recognise that they don't want any other big players in the games market, so release a near identical game which uses artwork directly stolen from your own game, all the characters you designed, the music, the logo, the backgrounds and the whole branding, they simply extract the assets and use them in their own version and release it under the Chillingo label . . . and having a comparatively massive advertising and promotions budget they kill off an indie developer like you or me in just a few days, your sales drop to 400 a day, then to 5 a day, then nothing.

It's around this time that you'd probably be more accommodating towards the idea of intellectual property and copyright laws.

    @Socks May I quote the above-mentioned post? :P
I've forwarded your blatant disregard for my intellectual property rights to my lawyers, Pluto, Pluto and Minnie. ;)

    Update:

    1. It has only been one week since I released the game on Kindle Fire, the game just surpassed the 200 download barrier without being noticed or shut down by Walt Disney yet.

You are doing well ! I expected you to be in the International-Disney-Jail-of-Fun by now (guards are dressed up as mice).

The unfortunate thing with schemes like this is that you need to keep your sales low to stay off their radar, as soon as you have anything that you might consider a success it will very likely get noticed and then it's game over.

    February 6, 2014 Downloads Update:

The game has reached a new downloads milestone of 603 downloads. This milestone was very possible, due to the game getting 40-50 downloads every day.
