If I'm entering into an agreement with someone overseas, regarding a partnership
how would we draw up a contract?

Get a lawyer to draw it up

If my partner lives in the US and I live in Australia, does the contract still hold?
Is it enough to have an agreement online, or should we have a legal contract to ensure
we keep our side of the deal?

Verbal agreements are OK if you trust the person, but if you don't know them, then absolutely get a legal contract.

Now that I think about it…get a legal contract anyway. Really, you should never leave any openings for you to get screwed.

If my partner doesn't keep his side of the deal, how would I chase him up?
Would I have to hire a lawyer?

I can get a contract for us. We will talk about it more by email.

But I think suing me and taking everything I have is harsh.

Oral contracts in the United States are binding for up to $500. Any more than that and you need it in writing. No matter what kind of contract you have, suing someone in a foreign country is not a quick, simple or cheap process, and you aren't guaranteed to get any money damages even if you win, so be careful.

well, i guess you still need a witness for an oral contract. And the biggest question is: What kind of partnership do you plan? Is it copyright right related? Copyright law is pretty much diffrent in every country of the world. For example (probably not acutally US/AUS related, just an example): If your partner provides you with graphics and you dont have a license aggreement (which cant be oral, informal though) he could sue you! I would advise you to contact a lawyer and work out what you have to pay attention considerng the kind of partnership
