If it's for you to play around with in Gamesalad and show your friends then you would be fine, if you plan to use the character in something you are going to sell then get your court suit out of the dry cleaners and speak up when the judge calls your name.

What Tynan meant, I believe was, "If it's going to be available to the public." Paid or not.

Even if it's free, you will not be able to use any music or sprite that you did not create, or get permission to use.

Taking someone else's property and selling it won't go down very well with the lawyers, taking someone else's property and giving it away for free won't go down very well either.
