If you've no permission from the copyright owner then yes, it is illegal; and yes, it is a form of stealing and it makes no difference that your app will be free. And if you did ignore this advice then a) Apple might reject your app or b) it'll get pulled after a complaint or c) you'll get taken to court for copyright infringement. Hope that helps.

... PS THere are quite a few copyright free music sites found in a google search, some free to use too. Good luck in finding the sort of music you're after.

I use Logic Express but also use GarageBand a lot too; it's more than good enough for getting together music tracks & SFX; it's quite a powerful little program, I've always thought. :-)
