Templates - Using them
Is it possible to take a template from someone (Either bought, or if it is free) and use it to make your own game. I'm asking if it's ok from a legal perspective to take a template, change it a bit, and upload it?

You should change the graphics to your own.
I also recommend adding more features to it, for example, if the game does not already have it, add a scoring system or star system. This is not needed but it will make your game better.
First of all, just releasing a template from the Marketplace as your own app, with or without a change in graphics, is not going to lead to any kind of significant sales. People are looking for something original. Using a template to learn GS is a good thing, or taking a template and using it as the base of a game you're making is fine (IMHO anyway).
Secondly, of COURSE you have to create your own graphics. Not only is it unethical to steal someone else's graphics, do you think people want to download 10 apps that have exactly the same graphics?
For example, if you wanted to take the background or the buttons, feel free, but make fair use of it.
They will usually mention if you can use any graphics.
If it says you can use everything in it including the art commercially then you're free to upload it if you want to. It probably wouldn't be a good idea but you're within your rights to do so if you wish
