hi,
i just signed up for gamesalad, but before i download the gs creator i had some questions on this TOS passage :

" 10. Reservation of Rights....gs reserves the right to independently develop and publish games that may be substantially similar to your Submission(s). To the extent that any game independently developed by GameSalad appears substantially similar to any of Submissions, you hereby waive any claims you may have against GameSalad arising therefrom."

if i created a simple board game (video game)

Q1. would i be partially "waiving" my copyrights in any way ?
Q2. what exactly could gs re-create, that is "substantially similar" to my board game ?
Q3. what would i be "waiving" here ...and why... does gs require this "waive"?
Q4. What i'm basically asking is :
if i was an outside developer ( NOT using gs creator ) then ... would i be BETTER off legally in blocking or stopping gs from making a "substantially similar" game to mine.
vs.
if i was an inside developer ( using gs creator ) then ... would i be WORSE off legally in blocking or stopping gs from making a "substantially similar" game to mine.

ANYONE or the administrator may please answer all 4 questions. i would greatly appreciate some clarification on the above 4 questions.
thanks in advance : )
