Games and the Law

There's one thing I was wondering for a while. Let's say you're making a game. A game in 3D, with a big city and cars in which you can cruise around. Let's suppose those cars are real brands. And let's suppose they can be damaged as well.

You would need a license to use the car / brand in your game, but what if it isn't a commercial product? What if you would be giving out your game for free, and you'd be earning your money by in-game advertising (on billboards next to roads in the game for example).

I'm just trying to figure out what the law is like at this point. Would it be illegal to use these cars and brands? Can the manufacturers say something? (I guess they always can)

I also know that you probably wouldn't be making a living out of in-game advertising, or at least not enough to compensate all the hard work. But I was really just wondering about the law and the brands, a possible loophole? What do you mean?


I started thinking about this some time ago when I was browsing the vehicles section on Humster3D (or whatever it's called), they have some really nice models and in the description for some vehicles it says they have detachable parts, so with something like the BeamNG physics you could basically make nice and realistic crashes with parts flying around everywhere.

    Yes it would unfortunately. It's the same thing with Madden Football. They have to go through MONTHS of agreements to get the rights to the NFL players.

    You may notice in some games like grand theft auto the names are slightly different than real life counterparts, which is actually funnier. Like Stallion instead of mustang. Mine would be a 75 Fiord pintass. :D

    If you look at the EA football games, they actually are endorsed by the NFL for the use of the team names, logos, stadiums and other licensing.
    The NFLPA (Players Association) is another seperate entity that they must secure licensing through if they want to use the real players on those teams.

    But as others have said before me, satire is often better anyway.
    A Ford Mustang in a game is unlikely to make me care more...
    A Fjord pintass would make me laugh... make me remember it and make me want to play more.
