Orbz's blast test (the first)

Hi all,
Ok so this is driving me crazy... In Orbz's first blast test there is a bar that follows the 'shrapnel' actors and stops at the heighest point that any of these actors gets to.
What I would like to do, but can't seem to wrap my head around, is to make the bar sit on top of these actors at the highest point that the actors are resting at (not the highest point they get to overall). Would anybody be kind enough to explain how this might work?
I've tried getting rid of the 'max height' variable and just following the shrapnel but this seems to just follow one in particular. If there's a bunch of actors all with the same name and actions would there be a way to select from amongst these the one that is sitting the highest at any time in the scene?

I'm still really stuck... even just pointing me in a good direction.
I tried just using a hit test on a line sitting across the page. The problem with that way is that if one object stops touching it, it will set my variable of "touching" to false even if another actor is still touching it, sort of overriding it when it shouldnt....
Anyways any help would be greatly appreciated.
