Copyright and Game Development

I just wanted to point out an article I just posted on copyright and the game developer. It's my experiences with copyright and licenses as it relates specifically to game development.

Hopefully, it will help

PS - I'm not a lawyer and nothing in the article is legal advice, just my thoughts and experiences with copyright and gamesalad game development.

"If you wish to take legal action against someone who violates your copyright, you will need to officially register it with the U.S. Copyright office."
    -from the beginning.

Shouldn't that be 'the damages available to go after changes whether you have registered a copyright or not'?

Are you referring to the Berne convention and section 411 and 412 of the copyright act? I should probably make that clear that you can't seek statutory damages or attorney fees for infringement that occurs before a copyright has been registered but you can use other legal actions - which few people can actually afford to do under section 411 (copyright lawyers are EXPENSIVE) without the ability to get attorney fees (under section 412).

But thank you for catching that. I've clarified it in my article.
