    It still is flippin' annoying though, as annoyed as QS is, I'm sure you'll agree, tshirtbooth. Though I'd agree with you that it's perhaps not Gendai's place to police games.

    As for Pause - I'm actually really happy with the way ios4 handles it. I can pause a game anytime. It's all I ever wanted :D

    I have to agree with Tshirt on this. It's blatant copyright infringement of Nintendo's product, but it's Nintendo's job to deal with it, not Gendai.

    I'm surprised the app has stayed in the store as long as it did though!

    But obviously this kid just cannot learn a lesson. Or just doesn't care.

    @QS: I guess that would be up to Gendai... Not sure at this point that they would do anything since they haven't already...

    Seems he's not the only one in the App store having a hard time passing up easy $ in the app store. Look at all the Mirror Apps that are making bank, and other silly entertainment apps. There are too many examples left and right in the app store making $ whether it is Copyright infringement, or misleading apps like Mirror ones.

    (Although if a consumer is idiotic enough to think that an iphone can actually turn into a mirror, I guess that's their own fault, and if Apple is boneheaded enough to allow this stuff, then I guess it is what it is. Unfortunate, but true)

Anyhow: people have been trying to get through to you that what you are doing is stealing, not only intellectual property but actual property as far as design and artwork is concerned. If I made a complete copy of one of your 27 games in development (yeah, right) and put my name on it would you be happy? I don't think so. I'll say again, just because Nintendo is a company and not an individual doesn't change anything. "If Nintendo doesn't give a !@#$% why should you?" doesn't wash either, but I can't be bothered to explain. But enough to say that it's the principle of the thing.

    If Nintendo fired themselves up by just 5%, you'd be burned to a frazzle, I can tell you. You would be made to be an example; you'd be taken to court. and I can bet I know what the judge would say after you told him (I paraphrase) "I stole intellectual property - other people's output from their talent - because I desperately needed a few bucks. I intend to steal a film score tomorrow, a novel manuscript the day after, and a song after that; but it's OK, I need a few bucks."

    I think I would have had less of a prob with this dev if this was the first version of the game he released. I feel like since he is using (somewhat) different graphics, and not just a pixel:pixel copy, that it is not as blatantly egregious.

    I actually think QS is right here, and Tshirt is missing the point a bit.

    I think Gendai has a responsibility to protect its reputation, and that of other developers using its product. Remember, the very first logo that comes up on the Duck Hunt game is the GameSalad one.

    It doesnt reflect well on the brand, or any of the other Express members who then have the same logo at the front of their products.

    Its not as much of a worry for pro users of course, but then again, Gendai's lack of visible interest in the issue might just be a cunning ploy to help push more users towards buying Pro accounts :)

    And im pretty sure Gendai could easily lodge a complaint with apple, under the grounds that its a misuse of their development software.

    I also think it just sets a bad example. Our villain of the piece openly admits and knows what hes doing is wrong and illegal, but still happily flaunts what hes doing on the forums.... inspiring others to follow his lead.

    Again, bringing the reputation of GameSalad into disrepute.

    I doubt he even spoke to a nintendo rep, and just told everyone that to get people off his back....

    Lets face it, if a Nintendo rep did tell you to get the game removed within a week, you'd be a complete idiot to push it, and risk it.

    Theres nothing in the GameSalad TOS that says he cant do what he's doing... If they banned him that would be illegal... He's going to continue, so theres no point in trying to stop him... The game "he made" actually has good reviews and people seem to enjoy it, so its not giving us a bad name... Drop it or go call the Nazis.....

    Can we start complaining about online leaderboards now?

    QS - right as ever.

    We've had a big thread here before when someone asked if they could publish the template games from GS - about how such crappy apps would effect the GS community at large.

    Stealing is stealing; in a business that is full of creative minds to have someone ripping off a big company like Nintendo is sad, but also raises the question of when we will see fellow Devs being plagiarized as well.

    To be mad about an injustice or crime ONLY if you are the victim is great, if you can do it - it saves a lot of time! For everyone else though, ripping off others and publishing with the same load screen we all do - well, I don't like it.
