Using the sprites and sounds from other games

If you end up using sprites or music from other games, do you have to contact those companies to get approval, or do you just have to name them in the credits if you end up using their sprites, music etc?

There are different cases for images and music (i.e. artwork).
Most artwork is under copyright protection. Those images should not be used without expressed written permission from the copyright holder. http://www.joystiq.com/2008/05/07/law-of-the-game-on-joystiq-copyright-copywrong/
Some images/music are under the Creative Commons or similar licenses. With those you can use freely, but you must adhere to the conditions of the license. http://openclipart.org/ and http://creativecommons.org/
Some artwork is just free to use as public domain. But most games ARE NOT public domain.
