Background interferening with actor

Hello I'm trying to make a game where if you touch the background you lose but when I test it if I touch something in front of the background I still lose. How do I do this without the background affecting what's in front of it?

@BRADDSALAD You can wrap your touch rule condition check inside a '0' timer like this.
