GAME STOLEN FROM GAMESALAD??

So my FIRST game "Gummy Bears" http://itunes.apple.com/us/app/gummy-bears/id415171408?mt=8 was just stolen in it's complete entirety, including description and everything.

I am assuming from Gamesalad since the play is exactly the same. See here: http://itunes.apple.com/us/app/bear-pop/id415443779?mt=8

So, my questions are...how can I remove my game from Gamesalad (so that it is not so easily stealable), and how do I kill this TSUNG-SHENG YU person? (or at least get their/my game removed)?

    You should contact Apple (Call them, don't email) and get them to get him to remove the game from sale. It's obvious yours was the first on the store, so there should be no issue there.

    As for how it was "stolen"... you would have to find out if they have used any of your code...or if it's just the graphics and gameplay they have nicked/copied.

    wow... that is full on brazen BS. I guess contact both GS and Apple developer support.

    Perhaps you can find a contact on this guys website (just perhaps consider that this person has been hoodwinked too .. as in someone may have stolen this and presented it to him as a completed project ... so I guess there's a small chance he's not the thief).

    I just downloaded it....and it is EXACTLY the SAME. He used GAMESALAD!

    He even forgot to take out half of my logo! WTF! This is Crazy!

    How can we find out his Gamesalad User Name???

    yeah...he has like 3 email addresses on there. This guy should be banned from GS, and is the same j/o who was asking 8 months ago if he could publish a TEMPLATE...WTF?

    Very discouraging for my FIRST game ever. Now just wondering how I can remove my game from GS play, because apparently people can just download them and republish them.

    GAMESALAD - Do something more to protect files uploaded to your site! I dont know how it works, i dont know how people get it off the site, i dont care, thats not my job, but it is your job to try and protect your communities efforts! I saw peoples concerns ages ago about uploading to the site as the project can be downloaded in full if you know what you're doing, so it seems nothing has been done about it and this vile scum is just taking everybodies hard work and trying to cash-in on it!

    I don't understand one thing - how can anyone stole your game (but it's obviously stolen) if you have all the graphics and project on your computer?

    Is this games uploaded to the GS site as demos (like the user examples)?

    Josh have you ever uploaded that game to the GS website? I know games that have been uploaded to the GS website can be downloaded, i remember hearing it on here a while back

    My guess is that this guy somehow hacked the GS publishing server and stole the published file, then just uploaded it to Apple. I'm no expert on these things, but that makes the most sense to me. If this truly is the case, GS needs to do a MUCH better job at protecting files and projects uploaded to their publishing server. I am not a lawyer, but this sounds pretty illegal to me.

    yes, unfortunately you can very easily take any game from the GS website. Whether it is set to be able to be downloadable or not.

    Im pretty sure, even if you never made it downloadable it can still be downloaded

    I read an article not to long ago (I wish I could remember the link) that said by default, most everything is "copyrighted" even if you don't have a legit copyright notice. Also, I'm not sure if this applies here, but your app's End User License Agreement (EULA) you chose in iTunes Connect might have something in there about game theft or duplication. You might want to check this out. I am very sorry this happened to you Josh and I hope that guy does get banned.

    The source of a "game page" deffo seems different now.

    still doesn't change the fact that he could have nicked them before the web change.

    Holy crap. I guess I won't be uploading my game to the GS website. This is just retarded. How does he think he can get away with that and it even still has your name on the game.

    If anyone is interested, here is my post about copyrights from other topic:

    Just my 2 cents (I'm not a native english speaker, so please excuse my poor language), copyright is owned by the creator of: the idea, video, book, photo, picture, drawing, software, other pieces of art etc. The creator doesn't have to write under his work that this is his property and you cannot use it in any way, that exceeds the personal use - His work IS ALWAYS protected by international law.
    You can use anything as the personal use, without a permission. Examples of personal use:
    1. You can show the movie on DVD that you own to anyone from your friends and family, but you cannot rent it, or make public (for example on the Internet or in cinema).
    2. You can have someone's photo on the computer, or in the frame on your desk, you can copy it and give it to your friend, but you can't make any profit from it, or use it in any form of advertisement.

    So, please remember that (shortcut):
    1. Everything that is made from an idea is protected by international copyrights. It include for example: texts (but not short news), photos, drawings, paitings, sculptures, books, videos, movies, scripts, software etc. But it dosn't include things such as: furniture (but not a unique pieces of art furniture), short news etc.
    2. Copyrights are valid, and protected by international law even if the creator doesn't write anything about it (for example: he doesn't have to write that his photo XXXX is protected and he own the copyrights). Copyrights are valid always.
    3. You can use anything that is protected by international copyrights if you use it in the personal use. I wrote few examples above.
    4. Copyrights are valid till the creator dies (I don't remember how many years have to past after his death). After that, his works belongs to everyone. So you can publish for example all books wrote by Shakespeare and make profit from it. Of course there are exceptions.
    5. If the law cannot identify the creator of (for example) a painting or book, the copyrights are no longer valid (see the 4th point).
    6. You can make quotes, but you HAVE to write an author and a source.
    7. You can make a parody of anything, but it could be tought to protect it in the court.

    That's all I think... But if I remember anything else, I will write it.

    TheMoonwalls is right. One thing I would point out is that copyrights warnings are not *needed* but they can be later used as proofs of intellectual property.

    I don't think suing him is a good solution, however. How many money are we speaking about? Are you ready to enter in a international disputation for that?

    I uploaded jungle bug to the GS website as non downloadable to show people the game, and to get some imput, and now I see this happen? Im honestly left speechless right now.

    is it still possible to update web games? couldn't you just upload one of GS's templates over your existing one?
