Also from my experience I can tell you one story: I know a guy who has shop with services for game designers (music, graphics, real actors etc.), contact with him is only through the Internet, or by the phone. He used services of my lawyer, after one guy ordered a music track (for about 400 USD), and didin't want to pay (he had only a small, low quality demo version). The CEO of this company won in the court, with help of my lawyer.
I just checked in Polish law - e-mails with information, that both sides are agreed about the service and payment, are evidence in the court.
Maybe because so many holes in US law, rating of US is now lower :P

I'm curious, how much time did you actually invest into the art? In suing, you have to consider both lawyer, court, and other various fees. If you're trying to recover $1000, you may end up spending a $1000 to get it. I suspect the only possible legal award would be the cost of the artwork, not any pun/dam awards. Thus, really try to think about this monetarily. Is this legal action worth a new investment? If you're just upset that someone turned cheap on you, well, shitzu happens. Keep the artwork, make a great game, and don't do business with the guy. I think this thread has sufficiently flushed him out.

It is a Doctorate, so you are correct and good luck to you. Its a lot of work!
Nothing can be done unless a work for hire agreement was signed. If that or another legal contract was not signed then you do not have a case against the person.
According to the person who finally did pay me full, he said he was not mutinysoft and that mutinysoft only posted on the forum for him. He said he doesn't want to ruin mutinysoft's reputation.
